Forced Expulsion through "Release". A Structural Form of Repression under the Limits of International Protection

This concept introduces and systematizes the phenomenon of forced expulsion through “release” as a distinct form of repressive practice not covered by classical legal categories such as deportation, expulsion, or voluntary emigration. Within this configuration, release from detention does not signify the termination of persecution or restoration of legal status, but functions as a mechanism of enforced removal beyond the territory of the state without formal expulsion and without completion of criminal prosecution.
The paper develops a theoretical model of the phenomenon, identifies its structural features, mechanism of reproduction, and criteria of verification and logical refutation. The model is derived from documented Belarusian practice and is presented as an analytical framework for identifying similar configurations in other political and legal contexts.
