O presente artigo analisa os julgados do Superior Tribunal de Justiça (STJ) que decidiram sobre a aplicação da teoria da perda de uma chance nos casos em que se discute a ocorrência de erro médico para deles extrair a respectiva ratio decidendi. A partir da análise dos acórdãos coletados no STJ, é extraída a ratio decidendi para, assim, bem identificar quais são os aspectos temporal, espacial, subjetivo e material que precisam se fazer presentes em um dado caso concreto, com vistas a resultar na necessidade de aplicação da teoria. Também é realizada identificação do panorama legislativo e pontuadas as principais considerações doutrinárias sobre a teoria. Ao final, são apresentadas as conclusões extraídas da pesquisa realizada.
Abstract (English)
This article analyzes the judgments of the Superior Court of Justice (STJ) that decided on the application of the Theory of Loss of Chance in cases in which the occurrence of medical error is discussed in order to extract from them the respective ratio decidendi. From the analysis of the judgments collected in the STJ, the ratio decidendi is extracted in order to precisely identify which are the temporal, territorial, subjective and material aspects that need to be present in a given case, with a view to resulting in the need to apply the theory. Identification of the legislative panorama and the main doctrinal considerations about the theory are also carried out. At the end, the conclusions drawn from the research are presented.
