Moore und Feuchtflächen im Oberlauf der Loisach - Hydrologischer Funktionsraum und Systemische Rechtsentwicklung (DE / EN)

Dieser Hintergrundbericht analysiert die Moor- und Feuchtgebiete im oberen Einzugsgebiet der Loisach („Murnauer Moos / Oberlauf Loisach“) als hydrologisches Funktionssystem und verortet sie in der Methode der Systemischen Rechtsentwicklung.

Ausgehend von der Beobachtung, dass Moorkörper, Grundwasserdynamik, Abflussregime des Flusses, lokale Kühlung, Biodiversität und CO₂-Speicherfähigkeit ein miteinander verbundenes ökologisches System bilden, stellt der Text diese funktionale Realität der bestehenden Verwaltungspraxis in Bayern gegenüber: sektorale Zuständigkeiten, projektbezogene Genehmigungsverfahren und das Fehlen einer institutionell verankerten, projektübergreifenden Funktionsbewertung des Ökosystems als Ganzem.

Der Bericht rekonstruiert den ökologischen und hydrologischen Kontext des Murnauer Mooses, skizziert den einschlägigen Rechtsrahmen (Art. 20a Grundgesetz, Art. 141 Bayerische Verfassung, bayerisches Verwaltungs- und Naturschutzrecht) und verknüpft ihn mit der europäischen Ebene, insbesondere Art. 191 AEUV (Vorsorge, Vorbeugung, Verursacherprinzip) sowie dem Nature Restoration Law (Verordnung (EU) 2024/1991). In dieser Perspektive wird die Moorlandschaft zu einem Testfall dafür, wie Wiederherstellungs- und funktionale Schutzpflichten für gekoppelte Fluss-Moor-Systeme operationalisiert werden können.

Der Text ist eng verbunden mit der präventiven Verwaltungseingabe nach § 13 BayVwVfG i. V. m. Art. 20a GG / Art. 141 BV zur hydrologischen Integrität des Systems „Murnauer Moos / Oberlauf Loisach“ sowie mit den anschließenden schriftlichen Antworten des Landratsamts Garmisch-Partenkirchen. Während die Behörde bestätigt, dass es in einzelnen Verfahren projektbezogene Gesamtbewertungen gibt, erklärt sie zugleich, dass eine projektübergreifende funktionale Bewertung des Moor-Fluss-Systems institutionell „nicht vorgesehen“ ist. https://doi.org/10.5281/zenodo.18406538

Vor diesem Hintergrund entwickelt der Bericht die Idee der Systemischen Rechtsentwicklung: eine Methode verfassungsgeleiteter Selbstkorrektur der Verwaltungspraxis, in der Art. 20a GG als Funktionsnorm zum Schutz der natürlichen Lebensgrundlagen verstanden und aktiviert wird. Als nächster strategischer Schritt wird ein unabhängiges hydrologisch-ökologisches Fachgutachten benannt, um ökologisches Systemwissen in konkrete Vorsorgeaufträge zu übersetzen. Zugleich schlägt das Papier vor, Rechte der Natur nicht primär als neues Klageinstrument zu verstehen, sondern als funktionalen Maßstab für staatliches Handeln innerhalb des geltenden Rechts, ausgerichtet an der ökologischen Integrität und Selbstregulation von Ökosystemen.

This background report analyses the peatlands and wetlands in the upper catchment of the river Loisach (“Murnauer Moos / Oberlauf Loisach”) as a hydrological functional system and situates them within the method of Systemic Legal Development.

Starting from the observation that peat body, groundwater dynamics, river flow regime, local cooling, biodiversity and CO₂ storage capacity form an interconnected ecological system, the text contrasts this functional reality with existing administrative practice in Bavaria: sectoral responsibilities, project-based permitting procedures and the absence of an institutionally anchored, project-overarching functional assessment of the ecosystem as a whole.

The report reconstructs the ecological and hydrological context of the Murnauer Moos, outlines the relevant legal framework (Art. 20a of the German Basic Law, Art. 141 of the Bavarian Constitution, Bavarian administrative and nature conservation law), and links it to the European level, in particular Art. 191 TFEU (precaution, prevention, source principle) and the Nature Restoration Law (Regulation (EU) 2024/1991). In this perspective, the peatland landscape becomes a test case for how restoration and functional protection duties can be operationalised for coupled river-peatland systems.

The text is closely connected to the preventive administrative submission under § 13 BayVwVfG i. V. m. Art. 20a GG / Art. 141 BV concerning the hydrological integrity of the “Murnauer Moos / Upper Loisach” system and to the subsequent written responses of the district authority of Garmisch-Partenkirchen. While the authority confirms that there are project-based overall assessments in individual procedures, it also states that a project-overarching functional assessment of the peatland-river system is “not foreseen” institutionally. https://doi.org/10.5281/zenodo.18406538

Against this backdrop, the report develops the idea of Systemic Legal Development: a method of constitutionally guided self-correction of administrative practice, in which Art. 20a GG is understood and activated as a functional norm for the natural foundations of life. An independent hydrological-ecological expert report is identified as the next strategic step to translate ecological system knowledge into concrete precautionary mandates. In doing so, the paper proposes to understand Rights of Nature not primarily as a new litigation device, but as a functional benchmark for state action within existing law, oriented towards the ecological integrity and self-regulation of ecosystems.
