The Nexus between Law and Humanity
Authors/Creators
Description
The relationship between law and humanity remains one of the oldest and most enduring philosophical inquiries in the field of jurisprudence. Law, as a human construct, is designed to regulate behaviour, promote justice, and maintain order, while humanity provides the ethical and moral compass that ensures law does not become an instrument of oppression. This paper examines the nexus between law and humanity, exploring how legal systems derive legitimacy from human values, social morality, and universal principles of human rights. It also considers the dynamic interplay between positive law and natural law, the humanitarian foundations of modern legal frameworks, and the contemporary challenges facing law in preserving human dignity amid globalization, technological innovation, and conflict. The analysis underscores that law devoid of humanity degenerates into tyranny, while humanity without law descends into anarchy. Hence, the mutual reinforcement between both domains remains essential for justice and peace in human society.
