Zakazane praktyki w zakresie wykorzystania sztucznej inteligencji na podstawie AI Act

W czerwcu 2024 r. zostało uchwalone Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2024/1689 w sprawie ustanowienia zharmonizowanych przepisów dotyczących sztucznej inteligencji. Głównym celem nowych regulacji jest zapewnienie odpowiedniego poziomu ochrony obywateli w zakresie wykorzystania sztucznej inteligencji. Mimo że pełne wejście w życie przepisów rozporządzenia będzie rozłożone w czasie, już dziś widać, że AI Act stanowi ważny punkt w zakresie norm prawnych regulujących nowe technologie.
Artykuł koncentruje się na omówieniu zakazanych praktyk w zakresie wykorzystania sztucznej inteligencji według rozporządzenia. Uwzględnia definicję AI sformułowaną w AI Act i przybliża wykorzystane w regulacji podejście do rozróżniania systemów stosujących sztuczną inteligencję oparte na ryzyku. Publikacja akcentuje wagę dostosowywania przepisów do zmieniających się realiów świata technologii.
Abstract (English)
In June 2024, Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence was adopted. The main goal of the new regulations is to ensure an adequate level of protection for citizens in the use of artificial intelligence. Although the full implementation of the regulation will take time, it is already clear that the AI Act is an important milestone in the legal standards governing new technologies.
The article focuses on discussing prohibited practices in the use of artificial intelligence according to the regulation. It considers the definition of artificial intelligence formulated in the AI Act and approaches the risk-based distinction of AI systems used in the regulation. The publication emphasizes the importance of adapting regulations to the changing realities of the technology world.
