Kendisi İmam Mustafa b. Abdillah b. Mü’min Ebû el-Hayrat el-Maliki el-Cezairi (1136h\1724)’dir. Cezayir’in saygın ve bilinen alimlerindendir. Alimler arasında fıkıh alanında yaptığı değerli çalışmalarıyla tanınmış olup, özellikle şeyh Halil b. İshak elMaliki'nin Muhtasar-ı Halil kitabına yaptığı ilmi katkılarıyla nam salmıştır. İmam Şemsüddin et-Tettaî’nin(942h/1535) Cevahirü’d-Dürer fi Halli Elfazi’l-Muhtasar adlı eserine yazdığı haşiyesi ile daha da tanınmıştır. Çalışmamıza konu olan bu haşiyesi,
maliki mezhebinin en temel eserlerinden sayılır. Nitekim İmam Şemsüddin et-Tettaî’nin Muhtasar-ı Halil’e yazdığı şerhteki ilmi hataları düzeltmiştir. Aynı zamanda maliki mezhebindeki fıkhi görüşleri analiz etmiş, zayıf olanları tespit ettikten sonra kendi
görüşünü ortaya koymuştur. Muhtasar-ı Halil adlı esere şerh yazanların düştükleri ilmi hatalara işaret etmiştir. Söz konusu bu eseri, net ve akıcı olmasından dolayı ön plana çıkmıştır.
Makale, yeterince tanınmayan müellifimizin ilmi ve şahsi biyografisini açıklar. Bilhassa, Nabiğ al-Ğallavî’nin (1245h/1848) de ifade ettiği gibi çalışmaya konu olan haşiyesi, maliki mezhebinin en temel eseri olma vasfını taşır.

scientific personality. This article also aims to try to define his great efforts to serve Malikit doctrine, through his jurisprudential footnote which won high status among the scholars of the Maliki school, it was mentioned by Al-Nabigha Al-Ghalawi (died 1245 AH / 1848AD) among the approved books in the Maliki jurisprudence, which are reliable in the doctrine, and their reference in the reports and jurisprudence footnotes that were written on the Mukhtassar of Khalil bin Ishaq ..
