В работе рассматривается понятие и правовая природа служебной тайны в законодательстве Российской Федерации. Служебная тайна, как особый вид конфиденциальной информации, играет важную роль в системе защиты коммерческих и государственных интересов, а также в обеспечении конкурентоспособности организаций. В исследовании анализируются нормы нормативных актов, регулирующие отношение к служебной тайне, включая Федеральный закон «О коммерческой тайне» и другие сопутствующие документы. Особое внимание уделяется критериям отнесения информации к служебной тайне, а также правовым механизмам её защиты. В работе рассматриваются особенности уголовной и административной ответственности за нарушения, связанные с раскрытием служебной тайны. В заключение акцентируется внимание на необходимости дальнейшего совершенствования законодательства в данной области для повышения уровня защиты служебной информации и создания благоприятной правовой среды для ведения бизнеса.
Abstract (English)
The paper examines the concept and legal nature of official secrets in the legislation of the Russian Federation. Official secrets, as a special type of confidential information, play an important role in the system of protecting commercial and government interests, as well as in ensuring the competitiveness of organizations. The study analyzes the norms of regulatory acts regulating attitudes to official secrets, including the Federal Law "On Commercial Secrets" and other related documents. Special attention is paid to the criteria for classifying information as an official secret, as well as legal mechanisms for its protection. The paper examines the specifics of criminal and administrative liability for violations related to the disclosure of official secrets. In conclusion, attention is focused on the need to further improve legislation in this area in order to increase the level of protection of official information and create a favorable legal environment for doing business.
