An Evaluation of Agricultural Land Consolidation in Türkiye in Terms of the Restriction of Property Rights

Abstract

The right to property, defined as the right granting individuals the broadest authority over a thing, is protected under both national and international legal frameworks. This protection arises from the fact that the right may be subject to interference by other individuals or even by the state. One such interference is the state's practice of agricultural land consolidation. Since the consolidation process directly affects the right to property, any such process must observe the limitations imposed on this right. In this context, actions relating to consolidation must be carried out by law and for the purpose of public interest. This study first examines the general issue of restrictions on the right to property. It then explains the types of land consolidation practices and, finally, analyzes the implementation stages of the consolidation process individually, within the framework of judicial decisions.
