Description

The right to a fair trial is recognized as one of the inalienable and fundamental human rights in the modern international legal system. This right includes a set of universal principles aimed at protecting the legal interests of a person in the judicial process, protecting him from unlawful restrictions, as well as ensuring the fair, independent and impartial conduct of judicial activities. The fundamental importance of the right to a fair trial is directly emphasized in international human rights norms. In particular, Article 10 of the Universal Declaration of Human Rights (1948) specifically states that everyone has the right to a public, fair and equal hearing by an independent and impartial tribunal in the determination of his rights and obligations and of any charges against him. Also, Article 14 of the International Covenant on Civil and Political Rights (1966) establishes a more detailed and binding normative framework for international standards on justice, imposing broad obligations on member states.
