Монографію присвячено дослідженню організаційно-правових засад здійснення контролю та нагляду за переміщенням лікарських засобів через митний кордон України. На підставі досягнень юридичної науки, узагальнення правозастосовної практики органів доходів і зборів, аналізу вітчизняного та зарубіжного законодавства надається науково обґрунтоване визначення категоріального апарату в провадженні досліджуваного контролю та нагляду за переміщенням лікарських засобів через митний кордон України, розкривається його зміст, форми, методи, види і джерела правового регулювання. Висвітлено особливості процедур митного контролю лікарських засобів, що містять наркотичні засоби, психотропні речовини та прекурсори. Надаються рекомендації щодо удосконалення законодавства в досліджуванній сфері і приведення його до вимог міжнародних норм і стандартів. Abstract
The monograph is devoted to the study of the organizational and legal principles of control and supervision over the movement of medicines across the customs border of Ukraine. Based on the achievements of legal science, generalization of the law enforcement practice of revenue and duties bodies, analysis of domestic and foreign legislation, a scientifically substantiated definition of the categorical apparatus in the conduct of the studied control and supervision over the movement of medicines across the customs border of Ukraine is provided, its content, forms, methods, types and sources of legal regulation are revealed. The peculiarities of the procedures for customs control of medicines containing narcotic drugs, psychotropic substances and precursors are highlighted. Recommendations are given for improving the legislation in the studied area and bringing it into line with the requirements of international norms and standards.
