Digital piracy has emerged as one of the most significant challenges to intellectual property enforcement in the twenty-first century. It encompasses the unauthorized reproduction, distribution, and streaming of copyrighted content, including films, music, software, and increasingly, over-the-top (OTT) platform content. The rapid advancement of technology, coupled with the accessibility of high-speed internet, has made India one of the largest markets affected by digital piracy. Although India has a comprehensive legal regime under the Copyright Act, 1957, strengthened by the 2012 amendments, the persistence of piracy raises questions about the practical effectiveness of these laws.
Judicial interventions, such as the Delhi High Court’s landmark ruling in UTV Software Communication Ltd. v. 1337X.to (2019), which introduced “dynamic injunctions” to block infringing websites, have strengthened enforcement. However, the rise of proxy and mirror sites, virtual private networks (VPNs), and cross-border hosting servers continues to undermine legal remedies. This paper critically examines whether India’s copyright laws and enforcement mechanisms effectively address the challenges posed by digital piracy. By evaluating statutory provisions, judicial approaches, and technological hurdles, the study seeks to determine whether India has struck the right balance between protecting copyright holders and ensuring affordable digital access for consumers.
