This research explores the role of Maqasid al-Sharia (the higher objectives of Islamic law) in achieving justice and equality between men and women within the Islamic framework.
The importance of this study stems from the ongoing debate on gender equality between Western and Islamic perspectives, emphasizing the need to highlight the balanced Islamic vision that harmonizes rights and responsibilities according to divine wisdom.

The study asserts that equality in Islam is not absolute sameness, but rather a form of justice guided by Sharia’s objectives, which consider human nature and the inherent differences between genders.

Islamic rulings address both men and women equally in moral responsibility, dignity, and accountability, while distinctions in certain rulings aim to secure benefit (maslahah) and prevent harm (mafsadah).

The universal purposes of Sharia—preserving religion, life, intellect, lineage, and property—serve as the foundation for establishing social justice and ensuring balanced gender relations.

The study concludes that Maqasid al-Sharia provides a dynamic and reformative methodology for addressing women’s issues. It bridges the gap between textual interpretation and modern reality, maintaining the authenticity of Islamic principles while promoting fairness and dignity for both men and women.
