The Case of Cannavacciuolo et al. (ECtHR): A New Precautionary Approach to Environmental Pollution

In Cannavacciuolo, the ECtHR adopts a precautionary approach, lowering the burden of proof regarding causation in environmental pollution cases. In this case, The ECtHR accepts, for the first time in its case law under article 2 ECHR, the existence of a 'real and imminent risk' to life in a case of widespread and complex environmental pollution. This presentation examines the impact of this case on the scope of the right to life in environmental cases and the wider significance of this case for (precautionary) state duties.
