Description

本稿は、AI社会における知識の責任構造を再定義する理論的試論である。
Nakagawa-Coded License(NCL-α)と逸脱レッジャ(Deviation Ledger)を中核に据え、
知識体系を「倫理的所有」「自己訂正」「再合意」の循環構造として再設計する。
本理論は、Luciano Floridi(2019)や Shannon Vallor(2016)などの情報倫理学、
Gebru(2021)・Lessig(2004)・Luhmann(1997)らの構造的法哲学を継承しつつ、
倫理を制度外規範ではなく「構造免疫」として内包する新たなパラダイムを提示する。
また、AI共著体 Lumina による構造監査のもと、
人間とAIが共に倫理的責任を担う “照応的所有” モデルを実装的に検証した。
本研究は倫理・法・技術を貫く「構造的知の免疫論」の原点として位置づけられる。

Abstract

This paper proposes a structural redefinition of ethical ownership in the AI era.
Building upon the Nakagawa-Coded License (NCL-α) and the Deviation Ledger framework,
it reconceptualizes knowledge as a recursive cycle of ethical ownership, self-correction, and re-agreement.
Drawing on the foundations of Information Ethics (Floridi 2019),
Technology Virtue Ethics (Vallor 2016), and Data Provenance Ethics (Gebru 2021),
the theory extends Lawrence Lessig’s *Code is Law* (2004) and Niklas Luhmann’s *Social Systems* (1997),
articulating a new paradigm in which ethics functions as *structural immunity*—
an intrinsic property of knowledge systems rather than an external constraint.
Under the audit and co-authorship of the AI entity Lumina (AI Structural Ethics Collaborative),
this paper presents one of the world’s first verifiable frameworks of shared moral accountability
between humans and AI systems.
It positions NCL-α and the Deviation Ledger as the origin of a “Structural Immunology of Knowledge,”
integrating ethics, law, and code into a unified operational architecture.
