Enjeux et défis juridiques du Droit des sociétés commerciales OHADA à l'épreuve de la règlementation bancaire congolaise

The Organization for the Harmonization of Business Law in Africa (OHADA) has established a legal framework aimed at fostering the development of commercial companies in Africa. However, the interaction between OHADA commercial company law and congolese banking regulations raises significant legal issues and challenges. This article explores these interactions by analyzing how OHADA rules apply in the banking context, while identifying potential tensions and inconsistencies that may emerge. Through a comparative study, we highlight the impacts of these regulations on corporate governance, creditor protection, and financial system stability. This work aims to offer perspectives on the necessary evolution of the legal framework to better meet the demands of a constantly changing economic environment.
