Este capítulo analiza la concepción y tratamiento jurídico de la herejía en la legislación del emperador Justiniano I, según el Corpus Iuris Civilis. Se expone cómo el pluralismo religioso romano dio paso a la declaración del cristianismo como única religión oficial del Imperio a partir del Edicto de Tesalónica (380 d.C.), con la consiguiente exclusión legal y persecución de las llamadas herejías y otras creencias consideradas desviaciones del dogma católico. El texto examina las categorías legales de herejes, maniqueos, samaritanos, apóstatas, judíos y celícolas, detallando las restricciones, penas y medidas aplicadas a cada uno bajo la normativa justinianeana, que pretendía consolidar la ortodoxia católica como única verdad religiosa y base del orden imperial. Se destaca la intensidad del rigor jurídico contra las herejías y la exclusión social y legal que implicaban, reflejando una transición histórica desde la libertad religiosa al control teocrático estatal.
Abstract (English)
This chapter analyzes the conception and legal treatment of herejía in the legislation of Emperor Justinian I, according to the Corpus Iuris Civilis. It explains how Roman religious pluralism gave way to the declaration of Christianity as the sole official religion of the Empire from the Edict of Thessalonica (380 A.D.), with the consequent legal exclusion and persecution of the so-alled herejías and other beliefs considered deviations from Catholic dogma. The text examines the legal categories of heretics, Manichaeans, Samaritans, apostates, Jews, and celícolas, detailing the restrictions, penalties, and measures applied to each under Justinian's normative framework, which sought to consolidate Catholic orthodoxy as the sole religious truth and foundation of imperial order. It highlights the intensity of the legal rigor against herejías and the social and legal exclusion they implied, reflecting a historical transition from religious freedom to theocratic state control.
