TOWARDS A SUSTAINABLE USE OF WATER IN AGRICULTURE: PROPERTY AND ASPECTS OF AN INCREASINGLY SCARCE RESOURCE

ABSTRACT

This work addresses the issue of water scarcity in the context of agriculture, taking into account the increasingly relevant concepts of sustainability and sustainable development in the law. It begins by examining the management of water resources in the international context, with particular attention to the possible recognition of a right to water. A historical approach is then adopted to analyse the legal status of water bodies, leading to a discussion of the ownership framework of water under contemporary italian law. The main instruments of water governance are subsequently presented, both public—such as concessions and planning—and private, including contracts and producer organizations. This is followed by a review of selected agronomic, economic, and legal techniques for the efficient use of water resources. Finally, the study touches upon the topic of the multifunctionality of agricultural enterprises, which is then explored through the discussion of specific aspects.

ABSTRACT

Il lavoro affronta il problema della scarsità idrica nel contesto dell’agricoltura. Ciò viene fatto avendo a mente anche il concetto, sempre più rilevante negli studi giuridici, della sostenibilità e dello sviluppo sostenibile. È inizialmente presa in considerazione la gestione delle risorse idriche nel contesto internazionale, con un accento particolare all’eventuale configurabilità di un diritto all’acqua; si è poi seguito un approccio storico allo studio dello statuto giuridico dei corpi idrici, sino ad arrivare alla caratterizzazione dominicale dell’acqua nell’ordinamento nazionale contemporaneo; sono poi presentati i principali strumenti del governo delle acque, sia pubblicistici – come la concessione e la pianificazione – che privatistici, come il contratto e le organizzazioni di produttori; a seguire si svolge una rassegna di alcune tecniche agronomiche, economiche e giuridiche per l’efficiente utilizzo delle risorse idriche; infine viene accennato il tema della multifunzionalità dell’impresa agricola, per poi discuterne alcuni aspetti specifici.
