Judgment by Algorithm? Policy Pathways for Ethical AI Integration in the Courts
Description
Artificial intelligence (AI) is transforming public institutions, and the judiciary represents one of its most consequential frontiers. This study develops a hybrid human–AI model designed to enhance efficiency and transparency without weakening due process or judicial independence. Drawing on comparative case studies from Estonia, China, South Africa, and the United States, it proposes a phased policy framework for responsible AI integration. The model emphasizes algorithmic transparency, judicial oversight, and public trust as the core conditions for legitimacy. Findings indicate that when AI operates as an augmentation tool under human supervision, courts can achieve measurable gains in efficiency while preserving fairness and accountability. The paper concludes with actionable policy pathways for embedding ethics, oversight, and revalidation into AI governance across judicial institutions.
