Nigeria’s energy sector faces numerous challenges, including limited electricity access, heavy dependence on fossil fuels, outdated infrastructure, and policy and regulatory uncertainties. With the country’s growing population and expanding economy, energy demand continues to rise, placing even greater strain on an already fragile and overstretched system. This makes the transition to renewable energy not only timely but imperative for Nigeria’s sustainable future. To support this shift toward sustainable development, Nigeria requires a strong and cohesive legal framework for renewable energy. This article provides a comprehensive analysis of the current legal landscape governing renewable energy in Nigeria, reviewing key laws, policies, and regulations such as the Electric Power Sector Reform Act, the National Renewable Energy and Energy Efficiency Policy, and the National Renewable Energy Action Plan (NREAP). The article also explores the roles of significant institutions, including the Nigerian Electricity Regulatory Commission (NERC), the Rural Electrification Agency, and the Federal Ministry of Power. Using a doctrinal legal research approach, it examines relevant legislation, regulations, and policy documents. While these laws demonstrate Nigeria’s commitment to embracing renewable energy resources, the study identifies several challenges within the legal framework that hinder the effective adoption of renewables: namely, the absence of a coherent and unified legal structure and weak enforcement mechanisms. To overcome these obstacles, the article concludes with recommendations to enact a consolidated Renewable Energy Act, clarify the responsibilities of involved institutions, and strengthen the enforcement of renewable energy policies to accelerate Nigeria’s energy transition.
