ТЕОРЕТИЧНІ ЗАСАДИ АНАЛІЗУ ІНСТИТУТУ ПРЕЗИДЕНТА

В статті розглянуто теоретичні засади аналізу інституту Президента. Обґрунтовано актуальність дослідження інституту Президента в Україні та показано його особливе місце у національній правовій системі. Визначено елементи інституту Президента та розкрито основні методологічні засоби дослідження цього інституту. Проаналізовано законодавство, що стосується інституту Президента України, специфіку його формального вираження у національній та зарубіжній практиці. Показано місце проблематики функціонування інституту Президента у правничо-історичної літературі.

The theoretical basis for the institution of the presidency analysis was shown. Additionally, the relevance of the study as well the special place of the presidency institution in Ukraine were justified. The elements of the institution following the methodological research methods of the institution were described. Special attention was shown to the legislation in terms of the presidency institution in Ukraine, in addition, the specificity of the formal expression in terms of the national and foreign practices. The place of the functional problematic, that the institution is facing was shown, referring to the historical and legal literature.
