Description
The problem of the emergence of state and law is one of the fundamental ones in the history of law. The issue has by now been on the agenda in the researches of modern scholars who, in their turn, rely on the working-outs of their predecessors, the founders of the national history of law, their students and followers who worked in the nineteenth and early twentieth centuries. A vast majority of their thoughts was pioneering and innovative and has not lost its relevance to this day. At those times, Slavic historiography put forward two main concepts in this regard. The first one, as noted in the present-day legal literature, is known as the theory of the spontaneous origin of the custom, the second one – as the theory of primary individual creativity. In accordance with the first concept, the basis of customary law was the common massive behavior of people, formed spontaneously and instinctively. According to the other theory, monotonous behavior was not formed spontaneously, but with the help of purposeful activity of individuals, and was subsequently followed by other people. According to the researchers of those times, the customary law is an ancient type of law formed in the pre-state era, which ensured the unity and survival of the society. The effectiveness of its norms was provided by all society institutes. Customary law is always ethnic. There is no customary law without its carrier – an ethnic group. The source of customary law was a legal custom, the norms of which are always organically linked with the religious and moral standards that prevail in the society. Researchers defined the law as a set of conditions necessary to reach reasonable goals of being by means of the intermediation of the active will of man. The purpose of the law is good. However, unlike morality, which purpose is good as well, only the external facets of the actions of people are relevant to the field of law. Law is separate from morality, although it should not contradict it.
