IMPROVING PROCEDURAL GUARANTEES FOR THE IMPLEMENTATION AND PROTECTION OF THE RIGHTS OF PERSONS ENJOYING IMMUNITY UPON ARREST

Description

The article covers the issues of ensuring procedural guarantees for persons enjoying immunity during detention. The analysis of the existing mechanisms for protecting the rights and interests of persons with immunity status in the context of their detention by law enforcement agencies is carried out. The article emphasizes the need for a balance between respect for the rule of law and ensuring the safety of society, as well as the protection of the rights and freedoms of persons with immunity. The study examines both national and international legislative and legal instruments aimed at guaranteeing a fair and lawful process for persons with immunity. The key problems and shortcomings in the existing practice are highlighted, and also offers recommendations for improving the detention process and ensuring the rights and legitimate interests of this category of persons. In conclusion, the article emphasizes the importance of further research and improvement of legislation to ensure the fair and effective functioning of the legal system in the context of immunity in detention.
