Правове забезпечення оцінки та продажу об'єктів гемологічних відносин

Постановка проблеми. Динаміці цін на гемологічні об’єкти притаманні не лише річні коливання, обумовлені впливом попиту та пропозиції, а й достатньо суттєва реакція на гемологічні властивості каміння, геолого-мінералогічні умови його залягання, гірничо-технічні способи та засоби видобування, а також місця і форми його реалізації. Натомість діяльності щодо оцінки та продажу об’єктів гемологічних відносин, тривалий час приділялася залишкова увага і не лише суто у експертних та/чи господарських аспектах, а й у їх правовому забезпеченні. Мета роботи полягає в аналізі актуальних питань цінової політики, системи правового забезпечення експертної оцінки та видів продажу об’єктів гемологічних відносин в Україні. Серед методів формально-юридичний, за яким визначено зміст і специфіку оцінки та продажу бурштину; правового аналізу з вивчення і розгляду приписів чинного законодавства, що регулює операції з об’єктів гемологічних відносин; порівняльно-правовий – розкрито спільні та відмінні особливості формування цін на необроблений бурштин в Україні та закордоном. Результати. Запропоновано розглядати поняття "ринкова ціна на бурштин", як ціну, за якою бурштин передається іншому власнику за умови, що продавець бурштину бажає передати, а покупець бажає його отримати на добровільній основі, обидві сторони є взаємно незалежними юридично та фактично, володіють достатньою інформацією про такий бурштин, а також ціни, які склалися на ринку бурштину або ідентичного каміння у порівняних економічних (комерційних) умовах. Встановлено, що порядок офлайн-продажу гемологічних об’єктів (крім бурштину) встановлює особливості щодо: мети продажу; суб’єкта пріоритетного права на придбання; обсягу продажу; підстав продажу; ціни гемологічних об’єктів. Порядок онлайн-продажу бурштину на е-аукціоні характеризується визначенням: суб’єкта і підстав проведення аукціону; підстав продажу; форм реалізації; об’єкта продажу. Висновки. Визначено сучасну систему правового забезпечення відносин оцінки та продажу гемологічних об’єктів: тарифи на роботи, пов'язані з проведенням гемологічної експертизи та форм висновків за її результатами; порядок продажу гемологічних об’єктів (крім бурштину); порядок продажу бурштину на е-аукціоні; порядок продажу на аукціонах гемологічних виробів; експеримент із продажу окремих гемологічних виробів на е-аукціоні.

Problem statement. The dynamics of prices for gemological objects is characterized not only by annual fluctuations caused by the influence of supply and demand, but also by a rather significant reaction to the gemological properties of stones, geological and mineralogical conditions of their occurrence, mining methods and means of extraction, as well as places and forms of their sale. Instead, the activities related to the valuation and sale of gemological objects have long received residual attention, not only in terms of expert and/or business aspects, but also in terms of their legal support. The purpose of this paper is to analyze the current issues of pricing policy, the system of legal support for expert evaluation and types of sale of gemological objects in Ukraine. Among the methods is the formal-legal one, which determine the content and specifics of amber valuation and sale; legal analysis to study and review the provisions of current legislation governing transactions with objects of gemological relations; comparative legal methods to reveal common and distinctive features of pricing for raw amber in Ukraine and abroad. Results. The author proposes to consider the concept of "market price for amber" as the price at which amber is transferred to another owner, provided that the seller of amber is willing to transfer it and the buyer is willing to receive it on a voluntary basis, both parties are mutually independent in law and in fact, have sufficient information about such amber, as well as prices prevailing on the market for amber or identical stones in comparable economic (commercial) conditions. It is established that the procedure for offline sale of gemological objects (except for amber) establishes specifics regarding the purpose of the sale; the subject of the priority right to purchase; the volume of the sale; the grounds for the sale; the price of gemological objects. The procedure for the online sale of amber at an e-auction is characterized by the definition of: the subject and grounds for holding the auction; the grounds for sale; forms of sale; the object of sale. Conclusions. The modern system of legal support for the relations of valuation and sale of gemological objects is determined: tariffs for work related to gemological examination and forms of conclusions based on its results; procedure for the sale of gemological objects (except for amber); procedure for the sale of amber at an e-auction; procedure for the sale of gemological products at auctions; experiment on the sale of certain gemological products at an e-auction.
