En los casos en que ha de acudirse a los tribunales para dirimir la existencia o no de una negligencia médica, y en consecuencia la valoración del daño que corresponda, se hace indispensable ilustrar al juzgador con un dictamen pericial elaborado por un experto en la materia. Se trata en este estudio de analizar la regulación básica de la normativa que afecta a este medio de prueba en el Derecho español y la línea jurisprudencial más importante sobre ella, realizándose a su vez un análisis comparado con sus homólogas colombianas.

Abstract (English)

In cases in which the courts must be resorted to settle the existence or not of medical negligence, and consequently the assessment of the corresponding damage, it is essential to enlighten the judge with an expert opinion prepared by an expert in the matter. The aim of this study is to analyze the basic regulation of the regulations that affect this means of proof in Spanish Law and the most important line of jurisprudence on it, carrying out a comparative analysis with its Colombian counterparts.
