PROTECȚIA MEDIULUI ÎNCONJURĂTOR ȘI SCHIMBĂRILE CLIMATICE. O ECUAȚIE PENTRU RECONCEPTUALIZAREA DREPTULUI LA UN MEDIU SĂNĂTOS ÎN DREPTUL INTERNAȚIONAL
Description
Sumar. Orice persoană are dreptul la o viață curată și sănătoasă și un mediu sănătos și durabil. Pe măsură ce drepturile omului și mediu sunt interdependente, un mediu curat, sănătos și durabil este absolut necesar pentru exercitarea unei game largi de drepturi ale omului. Totodată, pe tot globul pământesc, drepturile omului sunt afectate în mod negativ și încălcate drept consecință a schimbărilor climatice. De mai bine de jumătate de secol Dreptul internațional public în per-manență este îmbunătățit cu un cadru normativ care garantează dreptul la un mediu sănătos. Mai mult ca atât, deja este stabilit faptul că drepturile omului au o conexiune indisolubilă cu mediul în care trăiește fiecare ființă umană. Astfel, orice daună cauzată mediului de către fiecare persoană în parte intervine în exercitarea drepturilor omului.
