O Registro de Imóveis na Análise Econômica do Direito

Sob a ótica da análise econômica do Direito, apresenta-se a evolução histórica dos modelos de registro imobiliário. Existem dois modelos: o “Registro de Direitos”, em que uma autoridade judicial realiza a apuração de direitos para determinar e dar conhecimento geral de quem é o proprietário e o que é a propriedade; e o “Registro de Títulos”, em que este trabalho legal anterior não existe. Este artigo conclui que os Registros de Direitos são mais eficientes que os Registros de Títulos.

From the perspective of Economic Analysis of Law, the historical evolution of real estate registration models is presented. There are two models, "Registration of Rights" (Deed System), in which a legal authority performs the clearance of rights to determine and give general knowledge of who owns and what the property is, and "Registration of Titles" (Title System), in which this prior legal work does not exist. This article concludes that Rights Registries are more efficient than Title Registries.
