La propiedad intelectual y la inteligencia artificial como productora de mercancías estéticas

Within the philosophy of law, a model of intellectual property is currently being constructed that would allow the privatization of the product resulting from the computational process, but based on the assumption that artificial intelligence is comparable to human beings in their creative capacities. From this point of view, the recognition of the machine as a full subject of intellectual property is demanded. We will approach the discussion of this hegemonic vision from three axes: the nature of intellectual property, the nature of the subject and the nature of the appropriated object. We warn about the risks of the personification of the machine, questioning, in the first place, its inventive capacity to produce objective novelties since it lacks autonomy; and denying it, in the second place, the creative capacity of works of art for a different reason: artistic creation is a form of expression of the existential ineffable experienced as feeling and emotion by a singular subjective person. Every work of art is, by force, a singular expression of that subjectivity. Are machines conscious, do they feel and need to express their existential concerns? The machine, it will be proposed, can only be considered an artifact producing objects of non-art, mere merchandise within the framework of the patent, assignable to the owner of the fixed capital or to the one who has contracted the work.
Dentro de la Filosofía del Derecho se construye actualmente un modelo de propiedad intelectual que permitiría privatizar el producto resultante del proceso computacional, pero partiendo del supuesto de que la inteligencia artificial es equiparable al ser humano en sus capacidades creativas. Desde aquí se exige el reconocimiento de la máquina como sujeto de pleno derecho de la propiedad intelectual. Plantearemos la discusión de esta visión hegemónica desde tres ejes: la naturaleza de la propiedad intelectual, la naturaleza del sujeto y la del objeto apropiado. Se advierte sobre los riesgos de la personificación de la máquina, poniendo en duda, en primer lugar, su capacidad inventiva productora de novedades objetivas ya que carece de autonomía; y negándole, en segundo lugar, la capacidad creativa de obras de arte por otra razón distinta: el crear artístico es una forma de expresión de lo inefable existencial experimentado como sentimiento y emoción por una persona subjetiva singular. Toda obra de arte es, por fuerza, expresión singular de aquella subjetividad. ¿Las máquinas son conscientes, sienten y necesitan expresar sus inquietudes existenciales? La máquina, se propondrá, solo puede considerarse artefacto productor de objetos de no-arte, meras mercancías dentro del marco de la patente, adjudicables al propietario del capital fijo o de aquel que haya contratado el trabajo.
