Can non-open data standards legally taint conforming codebases and databanks?

Description

This presentation examines whether systems modeling artifacts — like modeling frameworks, high‑resolution databanks, and scenarios databases — might become derivative works of their informing semantic standards.  And if so, would the use of proprietary standards then taint the open science status of these artifacts in the process.  A diagram outlining this proposition is provided on slide 25.
