The protection of mother and child rights is not a new concept. Its actuality consists in the fact that, regulating family social relations that are in continuous development, its institution must also develop, respectively. That is why it must be subjected to a complex research according to forms and classifications, based on theory and practice.
Title II of the Constitution of the Republic of Moldova, entitled ,,Rights, freedoms and fundamental duties”, provides for the protection of mothers, orphans and socially vulnerable family members. Starting from the importance of the Constitution of any state, we can say that in this compartment the protection of the rights of the mother and the child is grounded as fundamental principles of constitutional law in terms of human rights. On the other hand, international legislation starts from the recognition of children and women as subjects of law, and in this capacity, their possibility to enjoy all civil, political, cultural, economic and social rights.
