By entering the Intracranial Tumor Segmentation (ICTS) Challenge 2021 (“Challenge”), you agree to the terms of data use and challenge rules defined below. If you do not agree, do not enter the Challenge.
"Competition Data" means the data or datasets available from the Challenge Website (https://ntuh.ml/) for use in the Challenge, including any prototype or executable code provided on the Challenge Website. The Competition Data will contain private and public test sets. Information on which data belongs to which set will not be made available to participants.
“Derivative Data” means data or information based on or created from Competition Data.
1. DATA ACCESS AND USE
You may access and use the Competition Data and the Derivative Data for participating in the Challenge purposes ONLY. Using any of the Competition Data or the Derivative Data for commercial purpose is strictly prohibited. Re-distribution or re-identification of any data is strictly prohibited. Following the Challenge's completion, these license terms may be revised, as determined by the contributing institutions at that time. The Administrator reserves the right to disqualify any participant who uses the Competition Data and the Derivative Data other than as permitted by the terms of data use and challenge rules. The Administrator reserves the right to verify participant eligibility and to adjudicate any dispute at any time.
Imaging studies used in the Challenge have been contributed by several sources and are de-identified patient data, meaning that the contributing institutions have taken reasonable care to remove from them all personally identifiable information. As a participant in the Challenge, you agree 1) not to make copies of, or in any way redistribute, any of the data made available to you, 2) not to attempt to re-identify any personal information based on the data, 3) not to attempt to probe the test set's labels, and 4) to notify the Administrator of any personally identifiable information you encounter in the data by sending an email to the Administrator.
You agree to use reasonable and suitable measures to prevent persons who have not formally agreed to these Rules from gaining access to the Competition Data and the Derivative Data. You agree not to transmit, duplicate, publish, redistribute, or otherwise provide or make available the Competition Data and the Derivative Data to any party not participating in the Challenge. You agree to notify the Administrator immediately upon learning of any possible unauthorized transmission of or unauthorized access to the Competition Data and the Derivative Data and you agree to work with the Administrator to rectify any unauthorized transmission or access.
2. USERS’ OBLIGATIONS
Users must fulfill the following obligations:
(a) deliver to the Administrator the final model's software code as used to generate the user’s best submission and associated documentation. The delivered software code should follow the documentation guidelines, must be capable of generating the user’s best submission, and must contain a description of resources required to build and/or run the executable code successfully. To the extent that the final model’s software code includes generally commercially available software that is not owned by you, but that can be procured by the Administrator without undue expense, then instead of delivering the code for that software to the Administrator, you must identify that software, method for procuring it, and any parameters or other information necessary to replicate the user’s best submission;
(b) grant to the Administrator the license to the user’s best submission, and represent that you have the unrestricted right to grant that license;
(c) sign and return all documents as may be required by the Administrator, including without limitation: (i) eligibility certifications; (ii) licenses, releases, and other agreements required under the Rules.
3. PUBLICITY
You agree that the Administrator and its affiliates may use your name and likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.
4. PRIVACY
You acknowledge and agree that the Administrator may collect, store, share and otherwise use personally identifiable information provided by you during the registration process and the Challenge, including but not limited to, name, mailing address, phone number, and email address (“Personal Information”).
5. WARRANTY, INDEMNITY AND RELEASE
You warrant that your submission is your own original work and, as such, you are the sole and exclusive owner and rights holder of the submission, and you have the right to make the submission and grant all required licenses. You agree not to make any submission that: (i)
infringes any third-party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights, or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations, or defames any person; or (ii) otherwise violates any applicable law.
To the maximum extent permitted by law, you indemnify and agree to keep indemnified Challenge Entities at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any of your acts, defaults or omissions and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the Challenge Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from: (a) your Submission or other material uploaded or otherwise provided by you that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations, or defames any person; (b) any misrepresentation made by you in connection with the Challenge; (c) any non-compliance by you with these Rules or any applicable Taiwan law; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to your involvement with the Challenge; and (e) your acceptance, possession, misuse or use of your participation in the Challenge and any Challenge-related activity.
6. INTERNET
Challenge Entities are not responsible for any malfunction of the Challenge Website or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed submissions or entry materials due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Challenge Website, or any combination thereof, which may limit a participant’s ability to participate.
7. RIGHT TO CANCEL, MODIFY OR DISQUALIFY
If for any reason the Challenge is not capable of running as planned, the Administrator reserves the right to cancel, terminate, modify or suspend the Challenge. The Administrator further reserves the right to disqualify any participant who tampers with the submission process or any other part of the Challenge or Challenge Website. Any attempt by a participant to deliberately damage any website, including the Challenge Website, or undermine the legitimate operation of the Challenge is a violation of criminal and civil laws. Should such an attempt be made, The Administrator reserves the right to seek damages from any such participant to the fullest extent of the applicable law.
8. Law
All claims arising out of or relating to these terms will be governed by law of Taiwan, excluding its conflict of laws rules. The parties consent to personal jurisdiction in those courts. If any provision of these Rules is held to be invalid or unenforceable, all remaining provisions of the terms will remain in full force and effect.
