Виникнення та розвиток безоплатної правової допомоги в Україні

Постановка проблеми. Безоплатна правова допомога в Україні є однією із засад правової системи в цілому. Прерогативу на правову допомогу зафіксовано на найвищому законодавчому рівні та закріплено в Конституції України. Інститут безоплатної правової допомоги пройшов довгий і важкий шлях історичного розвитку, дослідження якого є необхідним для удосконалення цього інституту в наші часи. Мета статті полягає у визначенні та характеристиці основних періодів становлення та розвитку безоплатної правової допомоги на теренах України від часів існування Київської Русі до сьогодення. Методологічну основу статті становить діалектичний та історичний методи наукового пізнання, за допомогою яких здійснено загальнотеоретичне дослідження історичного досвіду становлення й розвитку інституту безоплатної правової допомоги на території України. Результати. Встановлено, що інститут безоплатної правової допомоги пройшов складний і довгий шлях становлення та розвитку, але лише у незалежній Україні він став ефективним засобом захисту прав збіднілих верств суспільства, а отже, гарантом рівності перед законом і судами. Запропоновані шляхи надання якісної безоплатної первинної та вторинної правової допомоги в Україні. Висновки. Історичний досвід свідчить, що основними гарантіями надання належного безоплатного правового захисту особи від кримінального та адміністративного переслідування та надання представницьких юридичних послуг є: незалежність адвокатури, активна діяльність органів адвокатського самоврядування, чітке та повне визначення суб’єктів надання та отримання безоплатної правничої допомоги, а також достатнє фінансування з боку держави та благодійних організацій.

Problem statement. Free legal aid in Ukraine is one of the foundations of the legal system as a whole. The prerogative of legal assistance is recorded at the highest legislative level and enshrined in the Constitution of Ukraine. The institution of free legal aid has gone through a long and challenging path of historical development, the study of which is necessary for the improvement of this institution in our time. The purpose of the article is to define and characterize the main periods of formation and development of free legal aid on the territory of Ukraine from the time of the existence of Kyivan Rus to the present day. The methodological basis of the article is the dialectical and historical methods of scientific knowledge, with the help of which a general theoretical study of the historical experience of the formation and development of the institution of free legal aid on the territory of Ukraine was carried out. results. It has been established that the institution of free legal aid has gone through a difficult and long path of formation and development, but only in independent Ukraine, has it becomes an effective means of protecting the rights of underprivileged sections of society, and therefore, a guarantor of equality before the law and courts. Proposed ways of providing high-quality free primary and secondary legal assistance in Ukraine. Conclusions. Historical experience shows that the main guarantees of providing proper free legal protection of a person against criminal and administrative prosecution and the provision of representative legal services are: the independence of the bar, the active activity of the self-government bodies of the bar, a clear and complete definition of the subjects of providing and receiving free legal assistance, as well as sufficient funding from the state and charitable organizations.
