ЗАХИСНИК У ЗАБЕЗПЕЧЕННІ ПРАВ УЧАСНИКІВ КРИМІНАЛЬНОГО ПРОВАДЖЕННЯ

Summary.

Ukraine seeks to establish a European legal system that prioritizes the legal protection of a person under pressure from criminal law. The basis of reforming the bar is the establishment of guarantees of political, social rights and freedoms of man and citizen. Article C of the Constitution of Ukraine states that a person, his life and health, honor and dignity, inviolability and security are recognized as the highest social value. The state must ensure human rights, freedoms and private interests, guarantee inviolability, and in case of violation, take measures of legal responsibility of the perpetrators.

The article considers the theoretical and practical preconditions for further reform of the procedural activity of the bar and defence counsel in criminal proceedings. It is determined about the need to increase the requirements of advocacy, in particular to strengthen the professional and moral and ethical aspects of the status of a lawyer. Improving the procedure for improving the skills of lawyers; active development of cooperation with international professional organizations of lawyers for borrowing and introduction of their best practices; ensuring access to and openness of information regarding lawyers and advocacy in Ukraine.

In recent years, Ukraine has needed to reform Ukraine's criminal procedure law on advocacy and advocacy, especially in terms of improving protection in criminal proceedings, ensuring the participation of defence counsel in criminal proceedings, at the stage of pre-trial investigation and trial in court. Attention is paid to the professional and individual approach to the procedural status of a lawyer in criminal proceedings, especially at the moments of his mandatory participation to protect the rights and legitimate interests of the participants in the process. Suggestions for further improvement of the defence attorney in the criminal process of Ukraine are provided.
