Description
The article analyzes the essence of the controversy regarding the category of "limited sanity", it also emphasizes that there is still no clear definition of the criteria for limited sanity, and its setting is a difficult matter, which in practice leads to the avoidance of these legal categories. Researches the opinions of scientists and international experience in the introduction of this category are studied. It is noted that in practice this article is avoided, since the criteria for its establishment are rather blurred and ambiguous, and the affiliation of Ukrainian psychiatrists to two different scientific schools, which are opposite in content, further complicates the implementation of the Institute of limited sanity. The article emphasizes the fact that Ukrainian courts are mostly guided by limited sanity as a mitigating circumstance. An attempt has been made to study the issue of the legality and feasibility of the use of coercive measures of a medical nature by persons of limited sanity in terms of the Law of Ukraine "On Psychiatric Aid", the Constitution of Ukraine, international legal acts, which establish the general principles of provision of psychiatric care. As the current approach to punishment is limited to the perpetrators, which includes the possibility of imprisonment and the possibility of applying compulsory measures of a medical nature is fairly believed to create double pressure on this category of persons. The proposals of different scholars concerning possible alternatives for the replacement of compulsory measures of a medical nature with other penalties are analyzed, in the case of the introduction of a voluntary institution for the treatment of patients with limited sanity, in particular the prosecution of administrative evasion from compulsory measures of a medical nature or the replacement of compulsory medical measures on corrective or compulsory work. As a result of the study, possible changes to Art.20 and Art.93 of the Criminal Code of Ukraine in order to improve the legislation, namely: the possibility of providing psychiatric help to those who are severely punished by volunteering, taking into account the features of mental disorders that do not affect the sanity, and consent to the treatment to be taken into account as a mitigating circumstance in the appointment by a court of punishment.
