Legal Issues in Decisions on the Use and Storage of Research Data, especially in Inter-institutional Research Projects

Who may decide how research data from a research project are handled, where the data ultimately remain, and how the data can be further used? This contribution seeks answers to the above questions focusing on German and EU law. Therefore it examines the following aspects: First, what protection laws apply to research data? Second, who participates in the research project and who participates - in a legally relevant way - in the collection of the research data? Third, in which project phase are which decisions made?
