CONSENSUS INVERSUS: Evolving the Unanimity Mechanism for an Agile and Coherent European Union

Abstract (EN):
This paper proposes Consensus Inversus (CI), a procedural framework designed to resolve the "Unanimity Paradox" in the European Union's decision-making process. In the current geopolitical context, the EU's capacity for action is frequently constrained by the tactical use of the veto, turning an instrument intended to protect national sovereignty into a source of systemic paralysis.
The Consensus Inversus mechanism does not eliminate unanimity; rather, it transforms it from an absolute power into an argumentative responsibility. The proposal introduces a four-step procedure triggered automatically whenever a member state blocks a decision supported by an overwhelming majority (at least 22 member states or a group of states representing 65% of the Union's population).
The core pillars of the proposal include:
Justification Asymmetry: The vetoing state may choose between Path A - Justificatio Anonyma (anonymous, with a 14/26 protection threshold) or Path B - Professio Fidei (publicly assumed, with a high 18/26 protection threshold). This asymmetry is designed to incentivize political transparency.
Constructive Admissibility Filter: To be procedurally valid, any veto must be accompanied by an Alternative Compromise Proposal that maintains at least 70% of the initial proposal's intended impact.
Impact Matrix and Independent Audit: The assessment of relevance is based on objective legal and economic criteria, audited by an Independent Technical Panel (composed of experts from Eurostat, the ECB, and a retired CJUE judge), thereby eliminating political bias.
Procedural Bypass via Article 329 TFEU: In the event of an irrelevant justification, the veto is converted into a procedural opt-out. The Council automatically activates Enhanced Cooperation (Art. 20 TEU), allowing the majority to advance legally without violating the dissenting state's sovereign right to not apply the decision on its territory.
Compliance Scale and Rehabilitation Clause: A progressive sanctions system (including financial conditionality and "Tactical Blindness") paired with a clear mechanism allowing any state to return to the collective consensus.

The system's effectiveness was validated through a Monte Carlo simulation (10,000 iterations), with results indicating a 90% protection rate for legitimate vital interests and a 91% bypass rate for abusive vetoes. Consensus Inversus represents a "constitutional engineering" solution implementable through the Council's Rules of Procedure, providing the EU with the necessary strategic agility without requiring immediate Treaty amendments.

La présente communication propose le Consensus Inversus (CI), un cadre procédural visant à résoudre le « paradoxe de l'unanimité » dans le processus décisionnel de l'UE. Le mécanisme transforme l'unanimité d'un pouvoir absolu en une responsabilité argumentative. La proposition introduit une procédure en quatre étapes activée automatiquement lorsqu'un État membre bloque une décision soutenue par une majorité écrasante (au moins 22 États membres ou 65 % de la population). Elle utilise la Coopération renforcée (Art. 329 du TFUE) comme levier de déblocage tout en protégeant les intérêts vitaux légitimes.

Prezenta lucrare propune Consensus Inversus (CI), un cadru procedural ce își propune să rezolve „Paradoxul Unanimității” în procesul decizional al UE. Mecanismul transformă unanimitatea dintr-o putere absolută într-o responsabilitate argumentativă. Propunerea introduce o procedură în patru pași activată automat când un stat membru blochează o decizie susținută de o majoritate zdrobitoare (22 de state sau 65% din populație). Se utilizează Cooperarea Consolidată (Art. 329 TFUE) pentru a permite majorității să avanseze, protejând în același timp interesele vitale legitime.
