This article examines the impact of social media on freedom of expression, exploring legal boundaries in the United States, European Union, and other jurisdictions. It analyzes constitutional protections, statutory limits, and judicial interpretations addressing defamation, hate speech, misinformation, and incitement in the digital age. The role of platform moderation, algorithmic amplification, and government regulation, such as Section 230 of the Communications Decency Act and the EU’s Digital Services Act—is scrutinized alongside social dynamics like cancel culture and echo chambers. Through case studies and comparative analysis, this study highlights tensions between free expression and public safety, offering recommendations for balancing rights and responsibilities in online discourse. As social media reshapes communication, legal frameworks must evolve to protect speech while curbing harm.
