CRIMINAL ASPECTS RELATED TO AIR POLLUTION, THROUGH THE PRISM OF ECOLOGICAL SECURITY

Air pollution means the presence in the atmosphere of substances that, depending on the concentration and / or time of action, cause changes in health, cause discomfort and alter the environment. Air pollutant can be any substance in the solid, liquid, gaseous (vapor) state or energy (radiant, electromagnetic, ionizing, thermal, acoustic or vibrating) present in the air, which can have a negative effect on human health and / or on the environment; The air is composed of: nitrogen 78.09%, oxygen 20.94%, argon 0.93%, CO2, 0.03% neon, krypton, xenon, helium, hydrogen, ozone and other water vapor.

Criminal law (art. 230 Penal Code) criminalizes air pollution more than the established norms, as a result of the emission into the atmosphere of pollutants or violation of operating rules, or failure to use machinery, apparatus, purification facilities and control of emissions into the atmosphere, if it has caused considerable damage to the environment, the animal or plant kingdom, the health of the population or caused the death of the person.
