To Scrape of Not to Scrape? The Lawfulness of Social Media Crawling under the GDPR
- 1. University of Vienna
Description
Given the increasingly vast amount and detailed nature of data on social media paired with the accessibility and availability of large amounts of information, social media data is an ever-insightful source of knowledge for researchers and other third parties. The processing of personal data, including that derived from social media platforms, is regulated by the General Data Protection Regulation (GDPR) in the EU. This chapter describes the different categories of personal data found on social media platforms and outlines the techniques used to gather this data. This description provides the basis for the core analysis of this paper, which examines the applicable legal bases in the GDPR for data processing of personal data on social media by third parties and then for researchers, and the different conditions that apply depending on the purposes of processing.
