Concepts and Characteristics of Services Provided by the National Police in Ukraine: the Oretical and Legal Aspect

The article is devoted to the analysis of theoretical and legal approaches to the concept and characteristics of services provided by the National Police in Ukraine. Given the wide range of problems that arise in the service of the National Police, the ideological, scientific and legal foundations of the outlined legal phenomenon are studied. Based on the conducted scientific analysis of the concept and characteristics of police services, the authors express their own proposals aimed at further improving the administrative and legal support of this type of administrative services. It is noted that the basic principles of public service theory of policing can be learned from representatives of European legal doctrine. In our country, certain aspects of the provision of services by the National Police were considered in fragments in the context of the provision of administrative services in general. The authors emphasize that initially the formation of the «new police» provided for the creation of a service, rather than repressive and punitive structure, which ensures the implementation and protection of human rights. The perception of the police, which serves the public interests of citizens, is a reproduction of its main function of «serving and protecting» and involves the creation of new administrative and legal relations with their participation. Proper understanding of the new ideology of policing will ensure the prompt implementation of European standards of law enforcement in Ukraine and increase the efficiency of this law enforcement agency. Attention is drawn to the fact that the lack of a legislative definition of the concept of «police service», its properties and characteristics becomes the basis for discussion, opening unlimited opportunities for further research. Domestic scholars give it a different meaning: some argue that all police activities are service, others believe that this concept in the context of policing indicates the performance of state duties to individuals, and the adjective «police» characterizes the subject of these services. As a result, it is stated that police services are the consideration and resolution by the National Police, within its competence, of individual administrative cases at the request of individuals and legal entities in order to take appropriate decisions or take actions to acquire, change or terminate rights and responsibilities.
