International Experience of the Process of Re-Socialization of Convicts

The article analyzes the legal experience of the implementation of the process of re-socialization of convicts, the results of which necessitates to reform the system of correctional influence on convicts. It is established that before any civilized state there is a task to increase the effectiveness of the fight against crime. The reform of the criminal-executive system aims at a qualitative change in the organization of the execution of punishment, the formation of a new system of correctional influence on convicts, bringing the conditions of serving a sentence in line with international standards, which envisages the humanization of the conditions of serving a sentence, wide involvement of the public and the media in the process of correction persons sentenced to imprisonment in the form of deprivation of liberty.

The problem of the process of re-socialization of sentenced persons to imprisonment was not left out of the attention of scholars, as evidenced by the scientific publications of I. G. Bohatyryov, V. M. Trubnikov, L. P. Onika, I. S. Yakovets and other scholars. However, in recent scientific studies, the process of re-socialization of convicts was considered primarily from the point of view of criminal law and criminology, and the results obtained were mostly applied and did not reveal the fundamental aspects of the re-socialization of convicts. Therefore, in this article international experience was studied in developing the problems of resocialization of sentenced persons to imprisonment, the main positive trends that took place in the practice of its organization, the establishment of basic approaches to their conduct were revealed.

The purpose of the article is to analyze the international experience of legal regulation of the process of resocialization of sentenced to imprisonment. It is determined that "re-socialization" in its broadest sense is commonly used to refer to the process of "secondary" entry of an individual into the social environment as a result of "defects" in socialization or change in socio-cultural environment. An analysis of prisoners' re-socialization programs, developed in Germany, Norway, the Netherlands and the UK, has been carried out, which made it possible to conclude that the effectiveness of this process depends largely on whether or not the assistance provided to prisoners during the first years of their life after their release from places of imprisonment. Summarizing the analyzed experience, conclusions were drawn about the necessity of involving social organizations to prisoners, providing training for convicts, establishing at the legislative level the functioning of hostels for newly released prisoners, and establishing an institution for mentoring.
